By accessing or using the Site, or by placing a rental order with American Tent House, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Site or rent items.

1. Definitions

• "American Tent House," "we," "us," "our": Refers to American Tent House, the rental company.
• "Customer," "you," "your": Refers to the individual or entity renting items from American Tent House or using the Site.
• "Item(s)": Refers to all equipment, products, and accessories rented by the Customer from American Tent House.
• "Rental Period": The agreed-upon duration for which the Items are rented, starting from the time of pickup/delivery and ending at the time of return/pickup by American Tent House, as specified in your rental agreement.
• "Rental Agreement": The specific document (e.g., invoice, contract) detailing the Items rented, Rental Period, rental fees, and any specific terms applicable to your rental.
• "Site": Refers to the American Tent House website at [Your Website URL Here].

2. Rental Service Agreement

a. Acceptance of Terms: By placing an order for Item(s) from American Tent House, you agree to be bound by these Terms and the specific terms outlined in your Rental Agreement.

b. Order Placement: All rental orders are subject to availability and acceptance by American Tent House. We reserve the right to refuse any order.

c. Rental Fees & Payment:

* Rental fees are specified in your Rental Agreement and are due as agreed upon.

* Payment must be made in full before or at the time of pickup/delivery unless otherwise arranged and approved by American Tent House.

* Late payments may incur additional charges as outlined in your Rental Agreement.

* A security deposit may be required for certain items or rentals, which will be refunded upon the satisfactory return of the Items.

d. Rental Period: The Rental Period begins at the agreed-upon pickup/delivery time and ends at the agreed-upon return/pickup time. Items returned late will incur additional late fees, typically charged per day or part thereof, as specified in your Rental Agreement.

3. Customer Responsibilities

a. Condition of Items: You are responsible for inspecting all Items upon receipt. Any damage or missing parts must be reported to American Tent House immediately (within [e.g., 2 hours] of receipt) to avoid being held responsible for existing damage.

b. Proper Use: You agree to use the Items only for their intended purpose and in a safe and careful manner, following any instructions provided by American Tent House. You are responsible for ensuring that all users of the rented Items are adequately instructed in their safe and proper use.

c. Care and Protection: You are responsible for the proper care and protection of the Items during the entire Rental Period. This includes protecting them from weather, theft, misuse, and unauthorized use.

d. Return Condition: You agree to return the Items to American Tent House in the same condition as received, reasonable wear and tear excepted. Items must be clean and free from excessive dirt or debris. Additional cleaning fees may apply for excessively dirty returns.

e. Loss or Damage: You are fully responsible for any loss, theft, or damage to the Items from any cause whatsoever during the Rental Period, including but not limited to, fire, theft, vandalism, negligence, or improper use. You agree to pay American Tent House the full replacement cost for lost or irreparably damaged Items, or the repair cost for damaged Items.

f. Prohibited Uses: You shall not modify, alter, or repair the Items without the prior written consent of American Tent House. You shall not use the Items for any illegal purpose.

4. Pickup and Return / Delivery and Collection

a. Pickup: If picking up, you are responsible for safely loading, securing, and transporting the Items.

b. Return: Items must be returned to the agreed-upon location by the end of the Rental Period.

c. Delivery/Collection: If delivery or collection is arranged, fees will apply. You must ensure clear access to the delivery/collection site. Failed delivery/collection attempts due to your fault may incur additional charges.

5. Cancellations and Changes

a. Cancellation Policy:

* Cancellations made [e.g., more than 7 days] prior to the Rental Period may receive a full refund or credit.

* Cancellations made between [e.g., 3 and 7 days] prior to the Rental Period may incur a cancellation fee or partial refund.

* Cancellations made less than [e.g., 72 hours] prior to the Rental Period may result in no refund and the full rental fee being charged.

* Specific cancellation terms for large orders or custom items may apply and will be outlined in your Rental Agreement.

b. Changes: Any changes to your order must be agreed upon by American Tent House and may incur additional charges or affect availability.

6. Limitation of Liability

a. No Warranties: American Tent House provides Items "as is" and makes no warranties, express or implied, including but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

b. Customer Risk: You assume all risks inherent in the operation and use of the rented Items. You agree to indemnify and hold harmless American Tent House, its owners, employees, and agents from any and all claims, demands, losses, damages, liabilities, and expenses (including legal fees) arising out of or in connection with the use, possession, or operation of the Items during the Rental Period, including personal injury or property damage, regardless of cause, except where prohibited by law.

c. Indirect Damages: In no event shall American Tent House be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Site or Items; (ii) any conduct or content of any third party on the Site; (iii) any content obtained from the Site; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.

7. Intellectual Property

The Site and its original content, features, and functionality are and will remain the exclusive property of American Tent House and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of American Tent House.

8. Links To Other Web Sites

Our Site may contain links to third-party web sites or services that are not owned or controlled by American Tent House.

American Tent House has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party web sites or services. You further acknowledge and agree that American Tent House shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

10. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

11. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least [e.g., 30 days'] notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
